Fluendo SA is committed to protecting the privacy of all our customers and visitors of the website (“you”). This Privacy Policy explains our practices regarding the use of personal data collected and processed through our website.
This Privacy Policy is incorporated into, and considered a part of, our Website Terms and our software license agreement (EULA).
1. USER CONSENT
By submitting your personal data to us when registering for an account or when contacting us by email, you declare to have read and accepted the terms of this Policy. Without prejudice to the foregoing, you expressly and unequivocally consent to the collection and processing of your personal data (as identified below) by us, in one or more files under our responsibility, in accordance with the indicated purposes and this Policy.
2. DATA COLLECTION
Registration. Upon registering for an account, we will collect the following personal data: name, surname, date of birth, email, country, address (street, number, city, state, post code) and other information depending on the website that you registered in, such as sport, sport role, professional level.
Email. On sending us an email, we will collect the following personal data: email address, and any other information provided in your email. You are responsible for the accuracy of the information you provide to us. You may not give us any sensitive personal data.
Cookie Data. Our cookie policy is indicated here.
Refusal to provide any information marked as “required” or equivalent will lead to the refusal of the registration.
3. DATA COLLECTION
Purposes. Your data will be used for the management of your subscription and use of our software products. We will also provide you with information concerning your subscription and send promotional campaigns according to your interests, concerning the use of the Codec Pack, The Fluendo ONEPLAY Suite, LongoMatch, or any other product of ours. We may communicate with you three or four times a month, unless urgently required by exceptional circumstances (such as security issues that require immediate action).
We may collect information of your use of the website, your download of software and your interaction with the software for the purpose of analyzing only as aggregate information what campaign has more success, the patterns of research and other relevant information to improve our products. The basis for this use is our legitimate interest to improve our products and offerings. Individual data will be discarded no later than one year after collection or transformed into anonymous data.
4. USER RIGHTS
You have the right to access, rectify, erase, block, limit and oppose any processing of your personal data. You also have the right to obtain data portability and to seek redress from the competent Data Protection Authority. Moreover, you may at any time withdraw your consent to the processing of your personal data and information. This withdrawal will not have retroactive effects but will prevent you from purchasing our products and receiving support. In order to modify your preferences you must log in to your account and manage them on the ‘My Profile’ section where you will find an option to a) Unsubscribe from our communications and b) Delete your account.
The above is without prejudice to provisions of applicable law enabling conservation of data for the purpose of defending our responsibility and complying with mandatory legal obligations.
The aforementioned rights may be exercised by contacting us at contact@fluendo.com provided that you include a digital copy of your identification document such as identity card, or passport and your Fluendo account details.
5. COMMERCIAL INFORMATION
When ticking the option of ‘I give my consent to receive product and promotional information from Fluendo’, you are giving consent to receive communications via email, containing promotional information of our products and of those of our partners in the same or related sectors (software products, media products). Consent to receive the newsletter is entirely optional and refusal to consent will not lead to any other consequences than not receiving it. You may opt out at any time through the unsubscribe link in the email or by sending us an email at contact@fluendo.com.
6. GENERAL
This website contains links to other websites that are not owned or controlled by Fluendo. Please be aware that we are not responsible for the privacy practices of such other websites.
We reserve the right to amend the terms of this Privacy Policy and will notify you by providing a clear notice of these changes by email or on our website, and in this Privacy Policy. If you continue to access our website after such update, you will be deemed to accept the new terms. If you do not accept the update, please notify us and we will remove any of your personal data (except as required to be maintained for legal purposes), and you shall not access our website any longer.
Unless a specific local regulation sets forth to the contrary, the Privacy Policy is governed by the laws of Spain.
